Compliance obligations for the industry have increased over the years,  major changes in recent years such as the Financial Framework Amendment Act 2012 change and the Treasury Law Amendment Bill 2023.


Australian businesses must adhere to various compliance obligations but you can rest assured the data we access and retrieve on your behalf is completely above board, unlike many cowboys out there offering locate services and online searches! Checkmate is dedicated to compliance and data security adhering to all applicable Australian Legislation, industry codes of conduct, and industry best practices, such as the Privacy Act 1988 (Cth) and Australian Privacy Principles.  


We also comply with the Banking and Credit Union Codes of Practice and the Consumer Credit Code for consumer credit debt, and the ASIC/ACCC Debt Collection Guidelines, and are deeply committed to safeguarding the privacy of our clients and handling their information with the highest level of care and respect.

In other countries such as America it's often easier to locate a persons current whereabouts because their Privacy laws are nowhere near as limiting as we have in Australia. 


Think about all of the rules and restrictions we have in contacting customers and private information (with huge personal fines and such at stake!) - when and how many times we can contact someone, what we cant say in case staff 'embarrass or harass' someone, how to store information and ensure it's kept private etc, it can really restrict us in what information we can get/actions we can take! We are legally not allowed to GPS track someone, can't go on a gated property, companies are essentially powerless! 


Good news is those of us with experience can stay ahead of legislative changes and absconding individuals using evolving methods/resources other larger slower to move companies may not be familiar with yet such as web scraping and  toolsand OSINT, increasing use of AI as it becomes more engaged in professional services to assist in name variation searches/spelling errors etc. We endeavour to constantly trial new resources and look at new technologies/laws to ensure we stay the top of the skip trace game! 

  

With Kristy studying in 2023 the CPP30619 Certificate III in Investigative Services (FOR LICENCING in WA, QLD, NSW, SA and TAS) and with a current application underway for ISO certification (Information Security Management Systems), Checkmate also abides by the prescribed Code of Conduct and Code of Ethics held by many industry relevant associations such as the Institute of Mercantile Agents and the Australian Institute of Credit Management.
